The law firm employs various types of security technology and measures to protect your data in an appropriate manner against unauthorised access, use, loss or disclosure. The technology and measures are tested and, where necessary, amended at regular intervals.

4. PERSONAL DATA PROCESSED BY THE LAW FIRM

The law firm processes your personal data as a result of you using our services and/or because you provide or have provided services to us, on the grounds of our competences and obligations as defined by the law or because such processing is necessary in order to represent the legitimate interests of yourself, your company or another party.

An overview of the personal data that we (could) process can be found below:

  • Date of birth
  • Place of birth
  • Address
  • Telephone number
  • Email address

  • Bank account number
  • Other personal data that you actively provide within the scope of a specific matter

5. SPECIAL OR SENSITIVE PERSONAL DATA THAT WE (COULD) PROCESS IF SUCH IS REQUIRED FOR THE SERVICE YOU REQUESTED:

  • Criminal record, charges or convictions;
  • Personal data that includes race and ethnic background, political views, religious or faith-based convictions, union membership or medical data.

6. THE Purpose AND THE LEGAL BASIS FOR PROCESSING PERSONAL DATA

The law firm processes your personal data for the following purposes:

Data is always treated confidentially and never disclosed.

Your data is only used for the service you requested:

  • To defend your interests;
  • To inform you and/or to consult with you about your case;
  • To settle any payments; the firm also processes personal data where we are required to do so by law, such as data that we require for tax returns or to comply with the Law on the Prevention of Money Laundering. 

7. HOW LONG DO WE STORE YOUR PERSONAL DATA?

The law firm keeps your personal data for no longer than is strictly necessary in order to achieve the objectives for which your personal data was collected. The statutory period for storing personal data after a matter is concluded is five years.

8. SHARING YOUR PERSONAL DATA WITH THIRD PARTIES

The law firm does not share your personal data with third parties, but shall provide such only where it is required to comply with the statutory obligations or to perform the service.

We conclude data processing agreements with third parties that process your personal data at our instructions in order to ensure that the same level of security exists and that the confidentiality of your data is guaranteed. 

9. ACCESSING, CHANGING, erasing OR TRANSFERRING DATA

You are in principle entitled to access, rectify or erase your personal data by means of a written request. You also have the right to withdraw your consent to the processing of the data or object to the processing of your personal data by the law firm and you have the right to data portability.

Such a request should be sent to the above email address (hbsv@hbsv-law.be). In order to ascertain that the request to access the data originates from you, we ask that you also include a copy of your identity document. The information you provide shall be used solely to handle your request.

The law firm undertakes to respond as soon as possible to your request, with such no later than within thirty days. The law firm shall, in accordance with its statutory obligations, and with due regard for general interests and on the basis of the exercise or defence of a legal claim or the legitimate exercising of the right to freedom of expression and/or information, deal with your request.
